What is conveyancing?

Conveyancing is the method by which legal property is transferred from one person to another. Commercial and residential conveyancing solicitors are essential when it comes to the legal transfer of land, property, and other kind of premises. Thanks to our years of experience, Versus Law’s conveyancing team can provide reliable, relevant, and up-to-date advice to speed up your property purchase.

The conveyancing process has extremely stringent guidelines which need to be met in order to ensure the legal transfer of property. This includes several steps of paperwork, mortgage offers, the exchange and signing of contracts and more.

Once the conveyancing process is “completed”, the transfer of premises or land will be legal in the eyes of the law and the government. Typically, the conveyancing process is split up into three main sections. Our commercial and residential conveyancing solicitors in Manchester will guide you throughout the process from the moment you instruct us.

Before Contract:

  • The conveyancer will arrange local searches, organise a survey and review it. 
  • We will get the draft contract, arrange the mortgage paperwork, and carry our pre-contract enquiries between ourselves, and the other solicitors involved. 
  • Conveyancer reports back to the buyer on the results of the enquiries and searches. 
  • When the buyer is satisfied, arrangements are made for the deposit to be paid and the contracts signed. 

Before Completion:

  • The formal exchange of contracts is agreed between the buyer’s and seller’s solicitors. 
  • At this stage, both parties are legally committed to completing the transaction. 
  • Transfer deeds are drafted up in preparation for completion, in addition to carrying out pre-completion searches. 
  • The buyer’s conveyancer will apply for the mortgage at this point. 

After Completion:

  • Upon completion, the buyer’s funds are sent to the seller’s solicitors. The keys are then released to the buyer. 
  • Title deeds are then sent on to the buyer’s solicitors. 
  • Buyer’s solicitors arrange the payment of Stamp Duty Land Tax unless the property was purchased during a Stamp Duty Holiday or is exempt. 
  • Formal registration of the new owner and Land Registry notification occurs immediately after completion.
