What is a welfare benefit appeal?

You have one month to challenge any disagreements within your case the benefits agency involved. Challenging benefit disagreements involves many stages.

The first stage begins with asking the decision-maker to reconsider the decision made. If your case involves the DWP, this is called the “mandatory reconsideration” stage. If your case involves in Housing Benefit cases, this stage is called a “revision”.

If the claimant remains dissatisfied after step one, you can appeal. In most cases, you have a one-month time limit from the date of the mandatory reconsideration.

Consider, in some situations, there is no right of appeal in respect of a decision made with welfare benefits. If you have received an unfavourable decision in your first appeal and wish to pursue the possibility of a request to the Upper Tribunal, Vanstone Law may assist with this under our Welfare Benefits contract.
